In relation to discrimination and harassment complaints, the University has identified two types of Responsible Employees under the UC’s Sexual Violence and Sexual Harassment Policy and the UC’s Anti-Discrimination Policy. In both policies, the term, “Responsible Employee”, refers to a group of University employees who are required to report prohibited conduct, as defined by the policies noted above, to the Title IX Compliance & Discrimination and Harassment Prevention Office (Title IX/DHP Office). However, there are slight differences in the employees who fall under this criteria and the information they must report. These definitions are highlighted below.
In the UC’s Sexual Violence and Sexual Harassment Policy, a Responsible Employee is any University employee, who is not a Confidential Resource as defined by the policy, and learns, in the course of employment, that a student may have experienced Prohibited Conduct or that Prohibited Conduct may have occurred in the context of patient care. They must promptly notify the Title IX/DHP Office. This includes resident assistants, graduate teaching assistants, and all other student employees, when disclosures are made to them in their capacities as employees.
In addition, if any of the following people learn, in the course of employment, that any other person affiliated with the University may have experienced Prohibited Conduct, they must promptly notify the Title IX Officer or designee:
- Campus Police
- Human Resources Administrators, Academic Personnel Administrators, and Title IX Professionals
- Managers and Supervisors including Deans, Department Chairs, and Directors of Organized Research Units
- Faculty members
In the UC’s Anti-Discrimination Policy, a Responsible Employee is any of the employees listed below, who is not a Confidential Resource, and learns, in the course of employment, that any individual affiliated with the University may have experienced Prohibited Conduct, as defined in this policy. They must promptly notify the Title IX/DHP Office.
- Campus Police
- Human Resources Administrators, Academic Personnel Administrators, and Discrimination and Title IX Professionals
- Managers and Supervisors including Deans, Department Chairs, and Directors of Organized Research Units
- Faculty Members
When am I required to report as a Responsible Employee?
Responsible Employees are required to report as soon as possible to the Title IX/DHP Office.
“In the course of employment” means that the employee learned of the reported prohibited conduct while acting in their capacity as a University employee. Examples include while being “on-the-clock,” or while volunteering at a University-sanctioned event.
What am I required to report as a Responsible Employee?
Responsible Employees are required to share all information regarding the disclosure of prohibited conduct that they received. , including the names of any involved individuals, their contact information, and any details of the incident.
If your job responsibilities ordinarily would require you to investigate a report of disruptive behavior or intervene or resolve the issue, consult with the Title IX/DHP Office before taking any steps to assure compliance with all applicable laws and policies.
